How personal data is handled on this website
2. Hosting and technical provision
This website is provided via Lovable Cloud. Lovable Labs Incorporated provides the Lovable services. When the website is accessed, technically necessary data is processed. This may include, in particular, the IP address and approximate location, browser type and version, pages or features accessed, timestamps and time spent, session or device identifiers, and technical error or debugging data. Where Lovable processes personal data on behalf of PMsquare GmbH, this takes place under a Data Processing Agreement. For such processing, PMsquare GmbH acts as controller and Lovable as processor. The processing serves in particular to provide, secure, maintain and technically support the website. Our legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the secure and reliable operation of the website. The Data Processing Agreement expressly states that Lovable does not use Customer Personal Data to train, retrain, fine-tune or otherwise develop AI or machine-learning models. Lovable may process certain Service Data and Log Data for its own purposes, including security, billing, analytics, product development and platform improvement, acting under its own data-protection responsibility. Under the Lovable DPA, Service Data may also be used to train or tune proprietary machine-learning models used to deliver the services. According to the DPA, this does not apply to Customer Personal Data. The DPA expressly excludes a joint-controller arrangement between PMsquare GmbH and Lovable.
3. Contacting us by email
If you contact us at info@pmsquare.de, we process your sender address, the content of your message and the related communication metadata in order to handle your enquiry. The legal basis is Art. 6(1)(b) GDPR where the communication relates to pre-contractual or contractual matters, and otherwise Art. 6(1)(f) GDPR for handling other business enquiries. We delete this data once it is no longer required for the purpose of the communication, unless statutory retention obligations apply.
4. Cookies, analytics and tracking
Based on the website's current technical configuration, PMsquare GmbH does not use analytics or web-tracking services, marketing or advertising pixels, or a contact-form service. We do not set non-essential cookies. A consent banner is therefore not currently required for these purposes. This does not affect technically necessary functions or Service Data and Log Data arising in the hosting environment that may be processed to provide, secure and operate the website.
5. Recipients and service providers
We use Lovable for hosting and technical operation of this website. Where Lovable processes personal data on our behalf, it does so as a processor under a Data Processing Agreement. Lovable may engage sub-processors for this purpose. Under the DPA, those sub-processors are contractually required to meet corresponding data-protection obligations. Lovable maintains a list of its sub-processors and provides information about changes. Under the conditions of the DPA, the customer may object to a new sub-processor on reasonable data-protection grounds.
6. Transfers to third countries
As part of the Lovable services, personal data may be processed outside the EU or EEA, including in the United States. The Data Processing Agreement with Lovable provides appropriate safeguards for such transfers. For transfers from the EEA, the EU Standard Contractual Clauses under Commission Decision (EU) 2021/914 are incorporated. Where Lovable acts as processor, Module 2 (controller to processor) generally applies.
7. Your rights as a data subject
Subject to statutory requirements, you have the right of access, rectification, erasure, restriction of processing and data portability, as well as the right to object to processing based on Art. 6(1)(f) GDPR. Where processing is based on consent, you may withdraw that consent at any time with effect for the future. A message to info@pmsquare.de is sufficient to exercise your rights. You also have the right to lodge a complaint with a competent German data protection supervisory authority.
8. No automated decision-making
This website does not carry out automated decision-making, including profiling, that produces legal effects or similarly significantly affects you.
9. Data security
We and our technical service providers implement appropriate technical and organisational measures to protect personal data. The website is transmitted using HTTPS encryption. Under the DPA, Lovable commits to appropriate administrative, physical, technical and organisational security measures and to maintaining SOC 2 Type II and ISO 27001 accreditations for the duration of the agreement.
